WHAT IS A MEDICALLY DETERMINABLE IMPAIRMENT?

In order to receive Social Security disability payments, you must have what is called a medically determinable impairment which in simple terms means a serious medical condition; the main point is that your condition should not be temporary; it must last or be expected to last at least 12 months. Also, it must be supported by visits and treatment by a physician as well as supporting evidence of laboratory and radiological studies by x-rays or MRI examinations. Finally, your condition must be such that you are unable to perform work related duties.

Examples are a herniated disc, torn rotator cuff, arthritis of various joints such as hands and knees, heart, lung, kidney diseases and neurological problems including Parkinson’s disease, brain tumors and various malignant tumors.

Because of the various requirements when applying for disability, it is very desirable that you seek the services of an attorney familiar with disability cases.
